PCL Constructors Inc. ("PCL", also referred to herein as "we," "us," and "our") built the CraftLink app and website as free resources for users to use at their convenience and for the purpose of exploring employment opportunities and submitting expressions of interest in employment with PCL (the "Service"). The Service is provided by PCL at no cost to users and is intended for use as-is. PCL is committed to providing the Service in a manner that respects users' privacy rights.

This policy applies to personal information that is collected, used, or disclosed by PCL in relation to your use of the Service.

If you choose to use the Service, then you agree to the collection, use and disclosure of your personal information in relation to this policy. PCL will not use or disclose your information to anyone except as described in this policy.

What Personal Information We Collect and How We Use It

PCL collects personal information that is reasonably necessary for its legitimate business purposes, including to manage the employment application process and other potential employment-related functions for the PCL family of companies. PCL also collects information on applicants' race and gender to comply with government reporting requirements and to ensure equal employment opportunities. This information will only be used in ways that are consistent with all applicable laws, including, where applicable, US Federal affirmative action regulations.

All personal information collected is for the sole use of the PCL family of companies and may be shared among those companies. Except in accordance with applicable personal information and privacy laws, none of this information will be disclosed to any external parties except as set forth in this policy. If you have provided PCL with personal information and wish to request deletion of your data, please contact us so that we can take the necessary actions to remove the personal information. We will advise you of any consequences of having your personal information deleted.

When you create a profile, we may use the information you provide to match your experience and preferences with the job openings we have, and someone from PCL may contact you about a possible employment opportunity. Please note that by submitting your information regarding employment opportunities with PCL, you authorize us to transmit and store your information in our recruitment database for employment opportunities now and in the future.

Log Data

Whenever you use the Service, we may automatically collect data and information (ourselves or through third party products) which is often referred to as "Log Data." This Log Data may include information such as your device Internet Protocol ("IP") address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics. By collecting this information we get a better understanding of your needs and what Services we can develop, improve, market, and sell to you to meet those needs. Some of the information we automatically collect is necessary for the proper functioning of the Service, such as cookies as explained below. All the information we gather helps us understand your preferences and how well our Service is functioning so we can continually improve your online experience with us.

Connecting your CraftLink Account to Social Media Services

You can connect your CraftLink account to your accounts on third party services like Facebook and Google, in which case we may collect, use, disclose, transfer and store information relating to your account with such third party services. For example, if you connect with Facebook, we will store your Facebook ID, first name, last name, and email address and use them for the purposes of authentication when connecting to the Service.

If you connect with Google, we will store the email address you use to access your Google account for the purposes of authentication when connecting to the Service.

Any such collection, use, disclosure, transfer or storage of information will be done in accordance with this policy.

Cookies

Cookies are files with a small amount of data that are commonly used as unique identifiers. For example, when using a web browser, these are sent to your browser from the websites that you visit and are stored on your device's internal memory.

The Service may use implement cookies in a variety of ways, including third party code and libraries that use cookies to collect information and improve their services. Cookies may save your preferences while you are using our Services, such as allowing for persistent login on pages and in places that require logging in, and we may use them to provide you with tailored information and tracking as you use our Services. We may keep track of how you interact with links across our Services, including our email notifications. We do this to help improve our Services, provide information and advertising, and to be able to analyze aggregate click statistics such as how many times a particular link was clicked on. The Services may contain links to other websites, content embedded in our Services that comes from or relates to other websites and services, and now or in the future we may use buttons from other websites and services such as social media websites, and these third parties may use cookies or other tracking devices to collect and track information about you across the Internet. Service Providers

Personal and/or confidential information collected in connection with the Service may be used, processed, and/or stored in Canada or in the United States of America by PCL or a third-party service provider for the purposes of hosting, storing and managing the data. Such personal and/or confidential information may be subject to disclosure in accordance with the laws applicable in the jurisdiction in which the information is processed or stored; these laws might not provide the same level of protection for such information as would Canadian laws.

PCL may employ third-party companies and individuals for various purposes including:

To facilitate the Service;
To provide the Service on our behalf;
To perform Service-related services; or
To assist us in analyzing how the Service is used.

We want to inform users of the Service that these third parties may have access to some or all of your personal information in order to perform the tasks assigned to them on PCL's behalf. However, these parties are obligated not to disclose or use the information for any other purpose and your personal information is additionally protected by the service provider's privacy policy.

The following third parties are data processors for PCL and your personal information is shared with them for the purposes listed above:

PCL IP Management - analytics and measurement data processor
Microsoft - IT solutions and services data processor

Third party services providers may also include, but are not limited to Google Analytics. Google, Inc. may utilize the data collected to track and examine the use of the Services, to prepare reports on its activities and share them with other Google, Inc. services. Google, Inc. may also use the data collected to contextualize and personalize the ads of its own advertising network, such as by using cookies to serve ads based on a user's prior visits to the Service's website or other websites. You can prevent the collection of the data generated by Google Analytics in relation to your use of the Services website (including your IP address) and the processing of this data by downloading and installing the browser plug-in, with more information regarding how you can opt out of Google Analytics data collection as instructed here: https://tools.google.com/dlpage/gaoptout. This link provides instructions for installing an opt-out cookie on your device. As a result, the collection of data by Google Analytics is prevented in future for this Web Site and for this browser as long as the opt-out cookie remains installed in your browser.

In addition to the situations described above, we may use and disclose visitor information in special instances when we have reason to believe disclosing this information is necessary to investigate, identify, contact, or bring legal action against someone who may be causing injury to or interfering with our rights or property, other Service users, or anyone else. We may disclose information when subpoenaed, if ordered or otherwise required by a court of law, arbitrator, or other similar proceeding or the rules governing such a proceeding, for government investigations, with government agencies if required by law, to exercise, establish, or defend our rights, to protect your vital interests or those of any other third party, and when we otherwise believe in good faith that any applicable law requires it. When requests for personal information from external parties are received they are internally reviewed by PCL's legal and/or compliance departments and if it is determined that compliance is required, only the minimum amount of personal information required for the purposes of complying with the requests will be disclosed.

Combining of Information

Except as set forth in this Privacy Policy, we generally do not combine information about you that is collected on the Service with information we have related to you that is collected through means other than through the Service. We may combine information collected about you with information provided by third party service providers, such as those mentioned above. We may, but are not required to, combine information related to you collected outside of the Service for user authentication, such as to verify that when you log into portions of the Service that you are the authorized user of that account as determined by our corporate records, and that you have the authority to request information about you be provided to you, modified, or deleted.

Security

We caution users of the Service that internet communications are inherently vulnerable to interception, use, and/or alteration by person(s) other than the intended recipient(s). While PCL has implemented certain safeguards to reduce this risk, internet transmissions are still vulnerable. If you choose to use the Service, you do so at your sole risk.

Children's Privacy

The Service does not knowingly collect personal information from children under 13. If you are a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we can take the necessary actions to remove the personal information.

Business Transfers

In the event that we are involved in a bankruptcy, merger, acquisition, reorganization or sale of assets or change in our ownership or control, your information may be sold or transferred as part of that transaction to actual or prospective transactions partners and their consultants, advisors, counselors, and agents, and otherwise shared to facilitate that transaction before, during, and after that transaction is completed. The promises in this policy will apply to your information as transferred to the new entity.

Do Not Track

Presently the Service's website does not honor "do not track" settings on web browsers and does not offer you the opportunity to request that we not track your use of its services except as otherwise stated in this policy.

Deactivation of Account

If you wish to deactivate your account on our site, follow these steps:

Once signed into your profile, click on the profile dropdown and choose the Settings option.
Under Settings, click on Deactivate Account.
Confirm deactivation of your account by entering your Email address and clicking Deactivate.

Deactivating your account will also delete the connection between CraftLink and any third party services with which you connected your account (like Facebook or Google). Upon deactivation, your profile information (including any personal information related to your account with the third party service provider) will be removed from our active database, although some information may be retained for legal or operational purposes.

Changes to This Privacy Policy

PCL reserves the right to amend this policy from time to time without further notice and encourages you to refer to this policy regularly. Any changes are effective immediately after they are posted on this page. By using the Service, you are consenting to the contents of the then-current policy, and your continuing access or use of the Service after any changes constitutes your agreement to those changes. If you do not agree with the policy, please do not use the Service.
